In Louisiana, assets and debts acquired during the marriage are presumed to belong to both spouses. These assets and debts are known as community property. Generally, the expectation is that community property will be divided equally between the spouses in the event of divorce.
Separate property is not necessarily subject to division between the spouses. Separate property is generally defined as property that one spouse owned prior to the marriage or acquired by inheritance or gift during the marriage. A prenuptial agreement may also define certain items of property as separate property. Usually, to claim property as separate, the claim must be supported with specific documents, such as financial records.
