Federal Sentencing Guidelines
Penalties for federal crime convictions are generally based upon the level of offense and the criminal history of the defendant. However, Supreme Court cases of the 21st century (such as United States v. Booker) have deemed the guidelines violate the defendant’s Sixth Amendment right to a trial by jury. Therefore, federal sentence guidelines are no longer viewed as mandatory. Judges may use the guidelines, but are not required to issue a sentence within the guidelines.
