How does Louisiana law treat heroin?

There are many different kinds of drugs, and each of these drugs have different effects which affect the ways in which the law treats them. Some of the more minor drugs may bring relatively small penalties with them, but the law is far less forgiving when it comes to more serious drug crimes. These drug charges pay little attention to the amount of a drug and even sometimes to the specific crime; they are concerned only with the type of drug allegedly involved.

Unfortunately for those who have been accused of a heroin crime, heroin is one such drug. Heroin is illegal under federal law and also Louisiana state law, and in fact Louisiana law is extremely strict when it comes to heroin: even simple possession is a felony. For some drugs, possessing a small amount is not a large offense, and if you can have your charges reduced, you may be able to avoid steep fines or years of jail time. This is not the case with heroin.

Whether you are selling heroin or possessing it, whether you have less than a gram or more than one hundred grams, a conviction for a heroin crime is a felony. This means that being convicted of even a small amount of heroin could mean at least four years of hard labor and possibly a decade, as well as fines of up to $5,000.

Being convicted of the sale of heroin comes with even more serious penalties, which is why it is extremely important to enlist the aid of an attorney if you are accused of a heroin crime. You may think that because you were charged with only a small amount of heroin, it is not a big deal. Louisiana residents must remember that in our state, it is a big deal, because even the lightest penalties can change your life.
