Possession of child pornography

Possession of pornographic material that portrays a minor has been declared illegal by several federal and state laws. Due to the increase in information technology and social media activity, the laws are being utilized to punish Internet offenders. Those involved in the possession, sharing and distribution of child pornography face severe charges and ramifications.

The violation of child pornography laws may lead to hefty fines, as well as 15 to 30 years in prison. The accused could be prosecuted based on federal or state laws depending on the nature of the crime. Illegal activities crossing state lines are handled by the federal government. State laws might still apply, in which case both federal and state prosecutors will pursue a case against the defendant.

A person found guilty of the charges will have to register as a sex offender for life. This can make life difficult because it shows up on all public records. It becomes harder to get a house or a job. Refusal to register as a sex offender can have severe consequences as well. A list of all registered sex offenders in all 50 states is available online.

Being charged with possession of child pornography could have a daunting effect on your future. You could spend several years in prison if found guilty. Even after you get out, it will be challenging to start a new life. It is advisable to contact an experienced defense attorney as soon as you have been charged. The attorney will assess your case and try to get you off the hook.
