What Is Manslaughter?

Manslaughter is the killing of another person which would be murder under the First Degree or Second Degree Statute but the offense is committed in sudden passion or heat of blood immediately caused by provocation sufficient to deprive an average person of his self-control and cool reflection; or a homicide committed, without intent to cause death or great bodily harm when the offender is engaged in the perpetration or attempted perpetration of a felony not enumerated in the First or Second degree murder statutes, or any intention misdemeanor directly affected  the person.

Manslaughter Penalties

The penalties for manslaughter shall be imprisonment at hard labor for not more than 40 years. If the victim was under the age of ten, the offender shall be imprisoned at hard labor without the benefit of probation of suspension of sentence for not less than 10 years nor more than 40 years.
